Referral Scheme - Terms of Business

(“Terms”)

1. Introduction
These Terms apply to the referral scheme operated by Recruiterwise (part of Acapella Recruitment Ltd), a company registered in England & Wales (Company No. 10908417) with its registered office at 3 Boreham Road, Chelmsford, Essex, CM3 1NH (“we”, “us”, “our”). By taking part you agree to these Terms.

2. Eligibility

• Open to UK residents aged 18 or over.
• We may request proof of age or residence.

3. How to Make a Referral

• Provide the prospective client (“Referred Company”) with your unique referral code or ask them to mention your name when first contacting us.
• Alternatively complete our Referral Scheme form on our website - we will contact you and advise in the event that they are already a previous client.
• A referral is valid only if the Referred Company:
      a) has not previously used our services, and
      b) books and pays in full for at least one job-advertising campaign within three (3) months of the referral.

4. Reward

• For each valid referral you will receive a £50 Amazon.co.uk e-gift card (“Reward”).
• Referrals are paid once per successfully Referred Company (not per job advert.)
• Rewards are issued within 7 days after the qualifying invoice from the Referred Company has been paid in full.
• Maximum of 10 Rewards per person per calendar year unless we agree otherwise in writing.

5. Tax
Rewards may constitute taxable income. It is your responsibility to declare and pay any tax, National Insurance or other liabilities that may arise. We accept no liability for these obligations.

6. Data Protection

• We process personal data in accordance with the UK GDPR and the Data Protection Act 2018.
• Do not share a Referred Company’s personal contact details without their consent.
• Our Privacy Notice explains how we handle data.

7. Anti-Bribery
By participating you confirm that acceptance of the Reward does not breach any policy or duty owed to your employer or any other organisation and does not contravene the Bribery Act 2010.

8. Changes and Termination
We may amend, suspend or withdraw this scheme at any time by giving notice on our website. Referrals made before the change will be honoured if they meet these Terms.

9. Limitation of Liability
We are not responsible for:

• any loss or delay caused by circumstances beyond our reasonable control; or
• the acts or omissions of Amazon or any third party.

Nothing in these Terms limits liability for death or personal injury caused by our negligence or fraud.

10. Governing Law
These Terms are governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
